DMCA Copyright Policy

Best Fluffy Pancakes respects the intellectual property rights of others and expects its users to do the same. This policy outlines the information required in a valid DMCA notification and counter-notification. It is designed to make the process of reporting and responding to copyright infringement claims as clear and efficient as possible.

Filing a DMCA Copyright Infringement Notice

If you believe that material available on our site infringes on your copyright, please send a written notification to our Copyright Agent containing the following information. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is infringing your copyright.

  1. Identification of the copyrighted work claimed to have been infringed: Provide sufficient detail to allow us to identify the copyrighted work, such as a URL link to the original work, a title, or a description of the material.
  2. Identification of the infringing material: Clearly identify the material on our site that you claim is infringing, including its URL (web address) or any other specific location information that will allow us to locate it.
  3. Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  4. A statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of an exclusive right that is allegedly infringed or authorized to act on behalf of the owner of that right.
  6. Your electronic or physical signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Filing a DMCA Counter-Notification

If you believe that material you posted on our site was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. Please be aware that you may be held liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity was removed or disabled by mistake or misidentification.

  • Identification of the material: Clearly identify the material that has been removed or to which access has been disabled and the location (e.g., URL) at which the material appeared before it was removed or disabled.
  • A statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Include your full legal name, mailing address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Best Fluffy Pancakes may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your electronic or physical signature: A physical or electronic signature of the subscriber.
